				<content:encoded><![CDATA[<p>İstanbul Uluslararası Hukuk Topluluğu Derneği (ICIL), 18 Ağustos 2021 &#8211; 18 Eylül 2021 tarihleri arasında <strong>Yurtdışı Türkler ve Akraba Topluluklar Başkanlığının (YTB) desteği ve  Türkiye İnsan Hakları ve Eşitlik Kurumu (TİHEK) iş birliğinde düzenlenen &#8220;Araştırma ve Raporlama Eğitim Programı&#8221;</strong> düzenlemiş bulunmaktadır.</p>
<p>Program katılımcılarına akademik yazım ve raporlamaya ilişkin teorik eğitimlerin yanında, bu bilgileri pratiğe dökerek pekiştirdikleri, katılımcıya inisiyatif aldıran ve öğrenci eksenli işleyen bir yöntem benimsendi.</p>
<p>Proje sonunda katılımcılar, eğitim sürecinde ele alınan kriterler çerçevesinde ortak bir rapor hazırladı. TİHEK uzmanlarının riyasetinde gerçekleştirilen raporlama atölyesi çalışmaları ve kapasite artışı ile birlikte, katılımcıların gelecekte yapacakları diğer raporlama çalışmaları için de tecrübe kazanmaları sağlandı.</p>

				<content:encoded><![CDATA[<p>11 September 2020 &#8211; Turkish Red Crescent and Istanbul Center of International Law (ICIL) has recently organized the first online International Humanitarian Law (IHL) Moot Court Competition in cooperation with International Committee of the Red Cross (ICRC).</p>
<p>According to the press relase made by ICIL, The “Kırımlı Dr Aziz Bey” is the first of its kind online IHL Moot Court Competition. Around 36 teams comprising of students from various reputed law schools from all over the world participated in this competition.</p>
<p>The three day competition saw presence of notable experts of IHL like Valentina Azarova from Global Legal Action Network (GLAN), Anne Quintin from ICRC. The ICRC and judges appreciated Turkish Red Crescent and ICIL for organizing such an interesting competition and also congratulated the participants’ commitment and preparation for the competition and expressed their gratitue for taking part in its organization.</p>
<p>ICIL provided eight virtual lectures to get prapared for the competition and held it on Microsoft Teams rooms for the students to have a wonderful experience of arguing amidst an eminent panels of Judges, jurists and other leading legal practitioners of IHL.</p>
<p>The first position was awarded to University of Belarus. The runner up for this competition was the team from Amsterdam University. The Best Mooter prize was awarded to Fatmanur Banu Hayır from Galatasaray University and Todor Rogoshev from Plovdiv University, and the most developed team was awarded to National University of Malaysia.</p>
<p>Dr. Kerem Kınık, the president of the Turkish Red Crescent, stated that “It was heartwarming to find that such a global interest in the competition. The pandemic has created a situation where virtual courts are seen as remedy.”</p>
<p>Onur Dur, general coordinator ICIL said that “It is our aim to promote international law studies in Turkey and has appreciated the cooperation from Red Crescent and ICRC for organizing the “Kırımlı Dr. Aziz Bey Moot Court Competition”.</p>
<p>Mustafa Can Sati, the administrative director of ICIL has complimented the participants for their valued participation which will surely add strength to their career over and above sharpening their argumentative skill and the domain knowledge of law.</p>
<p>Prof. Dr. Sadi Çaycı from Baskent University and Anne Quintin from ICRC has given their closing remarks appreciating the efforts, need of such events, the contribution of such moot courts in the development of international legal profession and importance of recognition of the Turkey’s role in promotion and dissemination of IHL.</p>

				<content:encoded><![CDATA[<p>To represent Istanbul Center of International Law (ICIL) and Turkey, as team composed of students from different university, three members of ICIL family participated to the “All European International Humanitarian and Refugee Law Moot Court Competition” organized by Ljubljana University of Slovenia, this year. In this paper, general informative notes on moot court competitions and particularly about this competition will be given.</p>
<p><strong>Preliminaries Before the Competition</strong></p>
<p>Publication for applications of case was announced in 15 May 2017. In 15 September 2017, the case-study for the competition was published and forwarded to participants. Yet team works, which started towards the end of August 2017, intensified in the following month on the concrete subjects related with the case.</p>
<p><strong>Preparation Process</strong></p>
<p>The studies during the preparation process are conducted with the many meetings on a face to face basis or via online platform with team coach. With the publication of rules of procedures, related rules running the competition have been learnt.</p>

<p><strong>Contents of Competition</strong></p>
<p>The only valid language used in Competition is English. In ordinary moot court competitions there is an additionally memorandum writing which is similar to plaintiff and respondents petitions respectively, and the claims to be presented in the case proceed through these documents. Moreover, procedural rules of the moot court competition generally comprise detailed procedures related with the composition of the court and the appointment of the parties. However, due to the reason that the competition our members participated did not require memorandum and specified composition of the court and appointment of the parties in its procedural rules, we could not particularly emphasized on the facts of our party, but rather we studied all related subjects at the same time. After that the competition was held around 21 November and 25 November in Ljubljana, Slovenia. The detailed procedural rules on the composition of the court and appointments of the parties were given each time either 30 or 45 minutes before each rounds. In advence to these rounds, participants are informed about the party that they are going to plead on behalf of, before the court and which role they will be playing during the hearings.</p>
<p><strong>Result</strong></p>
<p>From the point of view until here, it could be said that the preparation process was intensive but at the same time instructive. The studies followed have provided an opportunity to have deep knowledge of International Humanitarian Law and International Refugee Law. Furthermore, the two sub-branches of International Law; namely, International Criminal Law and International Human Rights law, which used additionally in the case, has given us the ability to make comprehensive assessments on the complicated issues. Besides, thanks to the competition, it is also informed on the application of theoretical law to the concrete cases to evaluate states, relations of states with not only their citizens but also those who are under the their jurisdictions, and relations of states with other subjects of International Law, in specific context concerning abovementioned areas. In addition to all, by studying together and in harmony, our participants have remarkably experienced on these areas which have been studied rarely in Turkey. In this context, we express our thanks to team coach Dilara Yurtseven, who at the all stages of our preparation helped and spared time among her greatly intensive works, and to General Coordinator of ICIL, Onur Dur, who at all phases provided his supports.</p>

<blockquote><p>UN Economic and Social Commission for Western Asia (UNESCWA) just issued a landmark report about the situation in Occupied Palestinian Territories and Israel. For the first time, a UN body classified what is going on in the region as an “apartheid regime”. Moreover UNESCWA encouraged governments and civil society to support the Boycott, Divestment and Sanctions Movement which Israel considers as a threat to its existence. The report also faced with some opposition from the US and Israel. <p>1967’den bugüne, Filistinliler millet olarak, raporda belirtilen 4 ‘alanda’ yaşamlarını sürdürmekteler. Bu bölgelerde Filistinli nüfusun bazı kısımlarına görünürde farklı muamele edilmekte fakat hepsi ortak olarak apartheid rejiminden kaynaklanan ırkçı baskılara maruz kalmaktadır. Bu alanlar:</p>
<ol>
<li>Özel sınırlamalarla İsrail vatandaşı Filistinlilerin yaşamlarını idare eden medeni kanun;</li>
<li>Kudüs’te yaşayan Filistinlilerin yaşamlarını idare eden sürekli oturum kanunu;</li>
<li>Mülteci kamplarındakiler de dahil olmak üzere, Batı Şeria ve Gazze Şeridi’nde 1967’den beri süregelen işgal şartları altındaki Filistinlilerin yaşamını idare eden askeri hukuk,</li>
<li>İsrail’in kontrol ettiği alanın dışında yaşayan mülteci veya sürgüne gönderilmiş Filistinlilerin geri dönüşlerini imkansız kılma politikası.</li>
</ol>
<p>1.alan İsrail vatandaşı olarak yaşayan 1,7 milyon Filistinliyi kapsıyor. Bu kişiler, İsrail’in doğuşundan sonraki ilk 20 yılda sıkıyönetim altında yaşadılar ve günümüze kadar Yahudi olmamaları sebebiyle baskılara maruz kaldılar. Bu tahakküm politikası alt derece hizmetlerde, sınırlandırıcı imar kanunlarında ve Filistinli topluluklara yapılan sınırlı yardımlarda, mesleki ve profesyonel fırsatlarda ve çoğunlukla ayrılmış olan Yahudi ve Filistinli vatandaşların yaşam alanlarında kendisini açıkça göstermektedir. Filistinli siyasi partiler küçük reformlar ve daha iyi bütçeler için kampanya yürütebilirler fakat ırksal rejimi koruyan yasaya itiraz etmeleri Temel Kanun uyarınca hukuken yasaklanmıştır. Bu politika, milliyet ve vatandaşlık arasındaki ayrımın sonuçları tarafından da desteklenmektedir: Bütün İsrail vatandaşları, İsrail vatandaşlığını haizdir fakat ancak Yahudiler İsrail milletini oluşturur. İsrail hukukunda milli haklar Yahudilerin milli haklarını ifade eder. Dolayısıyla, İsrail’deki Filistinli vatandaşların İsrail hukuku altında eşitlik ve sivil reform mücadeleleri, başka yerlerdeki Filistinlilerin mücadelelerinden izole edilmektedir.</p>
<p>2.alan Doğu Kudüs’te yaşayan ve eğitim, sağlık, iş, oturum ve inşaat alanlarında ayrımcılığa maruz kalan 300.000 Filistinliyi kapsamaktadır. Ayrıca, bu kişiler İsrail’in, Yahudiler yararına, ‘nüfus dengeleme’ politikasına hizmet eden evden çıkarmalarla ve yıkımlarla karşılaşmaktadır. Doğu Kudüs’teki Filistinliler daimi sakinler olarak sınıflandırılmakta ve bu, onları İsrail’deki Filistinli vatandaşlara demografik ve daha da önemlisi seçimlerdeki ağırlıklarıyla ilgili katkıda bulunmaktan alıkoymaktadır. Daimi sakinler olarak, İsrail hukukuna itiraz etme hakları yoktur. Ayrıca, işgal altındaki Filistin toprakları’nda yaşayan Filistinlilerle alenen ilişkilendirilmeleri durumunda Batı Şeria’ya ihraç edilme ve Kudüs’ü ziyaret haklarının ellerinden alınması riskiyle karşılaşabilirler. Dolayısıyla, Filistin siyasi yaşamının merkezi, buradaki sakinlerin hukuki olarak apartheid rejimine karşı çıkma haklarının kullanımını engelleyen hukuki bir balon içerisinde sıkışmış bulunmaktadır.</p>
<p>3.alan, 4,7 milyonu Batı Şeria’da ve 1,9 milyonu Gazze Şeridi’nde olmak üzere işgal altındaki Filistin topraklarında yaşayan toplamda yaklaşık 6,6 milyon Filistinliye uygulanan askeri hukuk sistemidir. Bu bölge, Apartheid Konvansiyonu’ndaki apartheidin bütün şartlarını sağlayacak şekilde yönetilmektedir: soykırımla ilgili hüküm hariç, Konvansiyon’da belirtilen her gayriinsani fiil, İsrail tarafından rutin ve sistematik olarak Batı Şeria’da uygulanmaktadır. Buradaki Filistinliler askeri hukuka göre idare edilirken, yaklaşık 350.000 Yahudi yerleşimci İsrail medeni hukukunca yönetilir. Bu durumun ırkçı karakteri, İsrail vatandaşı olsun ya da olmasın, Batı Şeria’daki Yahudi yerleşimcilerin Yahudi olmaktan kaynaklanan korumaları haiz oldukları gerçeğince de ayrıca tasdik edilmektedir. Bu kendiliğinden problemli olan ikili hukuk sisteminin, ‘devlet arazilerini’ Yahudi nüfus yararına yönetmekle sorumlu olan Yahudi milli kurumların, arazi ve gelişmeyi ırka dayanan ayrımcılıkla yönetmesiyle birleşmesi bir apartheid rejiminin göstergesidir. Rapordaki genel bulguları destekleyici olarak, Ek 1 İsrail’in, işgal altındaki Filistin topraklarında Apartheid Konvansiyonu’nun 2.maddesini ihlal eden politikalarını ve uygulamalarını daha detaylı bir şekilde ortaya koymaktadır.</p>
<p>4.alan çoğu komşu ülkelerde yaşayan milyonlarca Filistinli mülteciyi ve istemsiz olarak sürgünde olanları ifade etmektedir. Bu kişilerin, İsrail’de ve işgal altındaki Filistin topraklarındaki evlerine dönmesi yasaktır. İsrail ise bu Filistinlilerin geri dönüşlerini reddetmesini açıkça ırkçı bir dille savunuyor: Filistinlilerin ‘demografik tehdit’ oluşturduğu i ve bu kişilerin dönüşlerinin İsrail’in demografik karakterini, Yahudi bir devlet olma özelliğini yok edecek şekilde değiştireceği iddia edilmektedir. Geri dönüş hakkının kullanımının engellenmesi, apartheid rejimi açısından temel bir öneme sahip. Bu şekilde bölgedeki Filistinli nüfusun, İsrail’in bölgedeki askeri kontrolünü tehdit edecek dereceye ve/veya İsrail’deki Filistin vatandaşlarına tüm demokratik hakları talep etme ve dolayısıyla İsrail devletinin Yahudi olma özelliğini ortadan kaldıracak şekilde Filistinlilere demografik üstünlük sağlayacak dereceye kadar artmaması sağlanmaktadır. 4.alanın, uluslararası hukuk altında Filistinlilerin ülkelerine geri dönüş haklarını inkar eden politikalarla sınırlı olmasına rağmen işbu raporda bu alan, apartheid rejiminin sürdürülmesindeki demografik etkenlerdeki kritik rolüne binaen, Filistinlilerin topluca baskı ve tahakküm altına alınması sisteminin ayrılmaz bir parçası olarak ele alınmaktadır.</p>
<p>Bu rapora göre, bu 4 alan birlikte değerlendirildiğinde bizzat İsrail’in kontrolü altında olan bölgelerde her kategoride Yahudi olmayanlar üzerindeki tahakkümün sürdürülmesini garantiye almak amacıyla geliştirilmiş kapsamlı bir rejimi oluşturmaktadır. Filistinlilere yapılan muamelelerdeki bu farklılıklar, bunların apartheidin bir şeklini oluşturup oluşturmadığına dair bir değerlendirme yok iken Birleşmiş Milletler tarafından meşru olarak kabul edilmekteydi. Bu rapordaki bulgular ışığında, uzun süredir var olan bu parçalı uluslararası yaklaşımın tekrar gözden geçirilme ihtiyacı hasıl olabilir.</p></blockquote>

				<content:encoded><![CDATA[<p>ICIL organized an intensive summer program on International Law and Human Rights from the 22nd of August to the 25th of August. Key topics what participants studied included Introduction to Human Rights Law, Introduction to Public International Law, the European System of Human Rights Protection, Sources of International Law, United nations Systems, Human Rights Implementation, the Use of Force in international Law. Cihat Gökdemir gave a speech and laid weight on necessity of international law in Turkey . The Summer school was further buttressed by a Moot Court Competition on ICJ’s Nicaragua v. US Case (1986). The lessons of the summer school were given by the experienced international law trainers Onur Dur, Ferhat Ercümen, Mahmut Sait Arslan, Selman Aksünger, Niyazi Ülkü, Kamil  Demir, Talha Şen Mustafa Yavuztürk. At the and of the summer program, social interaction and assessment dinner was held and the group that won the moot court contest was awarded.</p>

For this reason, our formation 2 programme students, Furkan Topcu and Bülent Öztürk, met with the coordinator of HUWISU Programme, Mr. Pierre Steuer. In this meeting, they presented our association, its formation programme, and also offered a cooperation included some convenience with regard to the accommodation and tuition fees for prospective programmes.</p>
